– REGULAR SESSION
September
10, 2007
The
Town of Seven Devils Town Council met in regular session on Monday, September
10, 2007 at Town Hall. Members present
were Mayor Bob Dodson; Mayor Pro Tem Richard DeMott; and Council Members Bill
Wilkinson, Kathy Copley and Town Attorney Rob Angle. Member Kay Ehlinger was absent and excused. Also in attendance were Town Manager Brad
Lambert and Zoning Administrator Don Fulkerson. Town Clerk Karen E. Daniels recorded the minutes.
CALL TO ORDER
Mayor Dodson called the meeting to order at 5:30 pm.
PLEDGE OF ALLEGIANCE
Council Members and citizens
recited the Pledge of Allegiance.
ADOPT AGENDA
Mayor Pro Tem DeMott made a
motion to adopt the agenda. Council
Member Wilkinson seconded the motion.
The members agreed unanimously.
APPROVE MINUTES

Approve
Minutes of August 13, 2007 Regular Meeting and August 24, 2007 Continuation
Meeting
It was requested on page two (2) sentence one (1) Mark
Carol be changed to read Mark Harrell.
Council Member Wilkinson made a motion to approve the August
13, 2007 regular meeting minutes and August 24, 2007 continuation meeting minutes
as amended. Mayor Pro Tem DeMott seconded
the motion. The members agreed
unanimously.
CITIZEN COMMENTS
Lenny Cottom, 2058 Skyland Drive stated
there are a few houses from Skiview to the front of the resort that trim their trees
and drag the limbs across the street onto the Golf Course property. He requested the owners keep their trimmings
on their own property.
STAFF UPDATE
The Town Manager made the
following additions to the Administrative Update.

The contract with Signet Golf has been signed.
·
Part of a fire grant Seven Devils is for purchase of a projector and
screen or flat screen TV to show videos for training purposes.
Member Wilkinson made a motion
for the Town Council to approve the purchase of the flat screen TV not to
exceed the amount of the grant. Mayor
Pro Tem DeMott seconded the motion. The
members agreed unanimously.

The Town Manager discussed the paving projects explaining Grandview from
the end of Devils Lake to Nettles Knob has been repaved. The parking lot expansion will be paved. Wildcat Rocks Road will be repaved and Rocky
Top will be redone. Last, Alpine Drive will
be repaved.
Member Copley stated the Council
has been putting money in the Capital Improvements Plan for approximately four
years so there will be no need for assessment or to borrow money.

The Town Manager stated the two piece replacement for the twenty two year
old backhoe was delivered and will save time and money.
OLD BUSINESS
A. Action on Tennis
Courts – Town Attorney Rob Angle – Attorney Angle stated he called Allen
Mosley after the last meeting and again today but he hasn't responded. – OPEN -
NEW BUSINESS
A. Telemark
Waterline Assessment Roll Resolution – Mayor Dodson stated Mayor Pro Tem DeMott
has requested to be rescused from voting on this Resolution primarily because
his land backs up to Telemark.
Mayor Dodson made a motion to rescuse
Mayor Pro Tem DeMott from voting on this Resolution. Member Wilkinson seconded the motion. The members agreed.
Mayor Dodson read from the
Resolution;

1) The total cost of the above
described project is hereby declared to be $123,669.30.
Mayor Dodson said, "This is
a little bit more than what we had anticipated but they ran into a huge rock
and they did not anticipate the additional work it would take to get the rock
out of the way."
Mayor Dodson asked the Town
Manager if the roll is ready. The Town
Manager stated we have it under a different name because it is the same
information we used at the start. We
will go through the data and inform the owners of all thirty (30) lots to be
assessed what that assessment will be.
Member Copley made a motion for
the Town Council to adopt the RESOLUTION DECLARING COST AND ORDERING
PREPARATION OF PRELIMINARY ASSESSMENT ROLL, AND SETTING TIME AND PLACE FOR
PUBLIC HEARING ON PRELIMINARY ASSESSMENT ROLL.
Mayor Pro Tem DeMott seconded the motion. The members agreed unanimously. – CLOSED -
B. Schedule Public
Hearing for Proposed Amendment to the Zoning Ordinance Section 12.3.1,
Application Submittal – Mayor Dodson read the proposed amendment,
"The Zoning Administrator shall submit all relevant documents." Mayor Dodson asked if there was urgency to
do this amendment at this time which would require a public hearing. The Zoning Administrator said, "The
momentum for this proposal was started by the Board of Adjustment so, the
Council may wish to discuss this with them.”
After discussion, the Council agreed to implement the principal now and
to defer the public hearing.

C. Personnel Policy
Workshops – Mayor Dodson asked the Council when they would like to start the
Workshops and if they wish to wait until after the elections as there may be
new members on the Council. After
discussion, the Council agreed to defer the Personnel Policy Workshops until
December. – OPEN –
D.
Use of Town Hall for "Meet the Candidates
Forum" – Mayor Dodson read the request from the Seven Devils Voter Information
Group to use the Town Hall for the Meet the Candidates Forum to be held on
October 18 from 6:30 pm to 9:00 pm. Mayor Dodson made a motion to approve the
use of Town Hall for the Meet the Candidates Forum. Member Copley seconded
the motion. The members agreed
unanimously. – CLOSED –
COMMITTEE REPORTS
A. Planning Board – Mayor Dodson
asked Planning Board Member Bob Haugh if the Rezoning Request for land on
Skyland Drive from Transitional to Recreational Business has been discussed
with the Town Attorney. Mr. Haugh
stated they are in the process of doing this and hope to have the information
at the next Planning Board meeting.
B. Public Works – Member Copley told the
Council a meeting is scheduled with Julie Elmore Coordinator of Blue Ridge
Resource Conservation Development Council, Mayor Dodson, Brad Lambert and
herself regarding a Stormwater Management Plan for the Town of Seven Devils. Member Copley said Julie has worked with
engineers who will develop the plan, write the grant and they will charge only
if the grant is funded.
C. Public Safety – Kay Lambert reviewed
the disbursement of funds from SafetyFest 2007.
D. ABC Board – Mayor Dodson said the
reason for the Cash Management fund is they are still looking for storage. They met with Hugh Fields and the owner of
the building next door. The owner
refuses to move. So, they are still
looking for storage.
E. Financial Report – Mayor
Dodson made a motion to accept the financial report. Council Member Copley seconded the motion. The members agreed unanimously.
F. TDA – There were no additional
comments.
TOWN COUNCIL COMMENTS
Mayor Dodson reviewed the August
2007 Fire Department Report. He asked
Tom Bookstaver if the Total Man-Hours of 426.5 was training man hours and Tom
said, "Yes". Mayor Dodson said the Seven Devils Fire Department
signed an auto aid agreement with Foscoe Fire Department. The Town Manager explained we had mutual aid
but the auto aid means Seven Devils will automatically be dispatched when
Foscoe has a structural fire. With auto
aid, all structure fires will have three (3) Fire Departments dispatched at the
same time. Mayor Dodson asked who the
Seven Devils three (3) EMT's are and Member Wilkinson said, "Bobby Powell,
Tom Bookstaver and Carl Hicks."
Mayor Pro Tem DeMott stated he
wanted to commend all the people who worked so hard on the SafetyFest. They did a wonderful job.

At 6:02 pm, Mayor Dodson made a
motion to adjourn. Council Member Copley
seconded the motion. The members agreed
unanimously.
