Board of Adjustment

Regular Scheduled Meeting

January 28, 2008 – 5:30 p.m.

Call to Order

The meeting was called to order at 5:30 pm by Town Manager Brad Lambert. Other board members present were Richard DeMott, Kathy Copley, Kay Lambert, George Ehlinger, Loren Williams and Bill Wilkinson. Town Clerk Karen Daniels recorded the minutes.

Nominate / Elect Board of Adjustment Officers

Member Williams made a motion to nominate Richard DeMott as Chairman. Member Wilkinson seconded the motion. The members agreed unanimously.

Member DeMott made a motion to nominate Bill Wilkinson as Vice Chairman. Member Ehlinger seconded the motion. The members agreed unanimously.

Oath of Office / Board of Adjustment Officers

Town Clerk Karen E. Daniels administered the oath of office to Chairman Richard DeMott and Vice Chairman Bill Wilkinson.

Adopt Agenda

Member Williams made a motion to adopt the agenda. Member Wilkinson seconded the motion. The members agreed unanimously.

Approve Old Minutes

• Approval of Minutes of August 27, 2007 Regular Meeting
• Approval of Minutes of August 31, 2007 Continuation Meeting

The Board requested the year 2007 be added to the top of the August 27^th minutes. Member Wilkinson made a motion to approve the minutes as amended. Member Ehlinger seconded the motion. The members agreed unanimously.

The Board requested a scrivener correction be made to the August 31^st minutes. Member Williams made a motion to approve the minutes as amended. Member Wilkinson seconded the motion. The members agreed unanimously.

Citizen Comments

None

Old Business

Member Williams ask for an update on the lawsuit. Chairman DeMott ask the Town Manager if we have received a copy of the transcript. The Town Manager indicated we have not received a copy of the transcript. Chairman DeMott said he would contact the Town Attorney for a copy.

Board Member Comments

Member Copley requested an update on the Sasha and Grace Bubanja fine for cutting trees. The Town Manager indicated the fine had not been paid. A discussion followed regarding replacing trees plus a fine or replacing trees in lieu of a fine.

Member Copley made a motion to go the Planning Board for clarification of how to handle replacing trees verses a fine for tree cutting. Member Wilkinson seconded the motion. The members agreed unanimously.

The Board requested the Town Clerk get updated copies of all Ordinances, Comprehensive Land Use Plan and Vision Statement to all Board members.

Chairman DeMott read a letter from Member David Hooper resigning from the Board of Adjustment, effective January 22, 2008. Chairman DeMott stated we have two (2) applicants for the position, Barbara Hurlbrink and Carol Sommer-Isquith. Discussion followed regarding how to fill the position in a timely fashion. The Board requested the Town Manager place the opening for the Board of Adjustment on the Town Web Site and to also place a sign on the door of Town Hall.

At 5:55 pm Member Williams made a motion to adjourn. Member Copley seconded the motion. The members agreed unanimously.
